网络以空前的广度和深度渗透到大学生的日常学习、生活及情感等各个方面，为其学习知识、交流思想、休闲娱乐等提供诸多方便。但部分大学生在享受网络所带来诸多便利的同时，又滥用了这项权利，走入法律法规的禁区。随着网络信息化的深入发展，大学生网络行为法律规范呈现出诸多问题，尤其是手机网络技术发展以来，大学生的网络活动更为频繁，其网络行为的违法失范也更为普遍，侵害和被害的几率也大幅增加，引发了严重的社会问题，对网络社会秩序的建构及网络文明规则的确立极为不利，影响了大学生的健康成长及顺利成才，这一现象已成为网络化时代背景下，高校思想政治教育面临的最为棘手，却又亟待解决的问题。党和政府心系青少年的健康成长和顺利成才，对其网络活动给予了高度的关注和政策性指导：胡锦涛同志在共青团十四届四中全会上讲话强调“要趋利避害，积极防范互联网给青少年带来的负面影响”[1]；《中共中央国务院关于进一步加强和改进大学生思想政治教育的意见》中也特别强调“要运用技术、行政、法律手段加强网络的管理，严防各种有害信息在网上的传播，牢牢把握网络思想政治教育的主动权”[2]，国内外学者针对青少年网络行为的违法失范问题，也给予了很多宝贵的建议和意见。因此，笔者在国家网络政策的指导下，在借鉴相关学者研究成果的基础上，进行问卷调查，探讨大学生网络行为法律规范的现状，对其进行理性的思考并作深入的探究。 本文主要通过查阅文献、抽样问卷调查、借鉴相关经验等方法展开分析研究，发现当前大学生网络行为法律规范存在以下突出问题：（1）网络法律规范意识淡漠；（2）网络法律法规知识匮乏；（3）网络法律法规适用不佳；（4）网络行为违法违规现象普遍等。通过研究分析发现以上问题产生的主要原因有：网络环境及现实社会环境的双重影响与制约；高校对大学生网络法律法规教育的重视程度不够；大学生网络道德自律松懈；特定心理动机的驱使等。综合上述理论分析和实际工作研究，本文在借鉴相关学者研究成果的基础上，提出大学生网络行为法律规范问题的教育对策：（1）完善网络法律法规及社会教育，加强大学生网络法律规范意识的培养；（2）高校应重视网络法制教育，强化大学生网络法律知识；（3）坚持网络道德规范教育，培养大学生的网络自律能力；（4）大学生应加强自我教育与管理，提高自身网络法律素养。同时，为了使上述教育对策能够有效顺利实施，提出相关部门应加强网络的监管，净化网络信息环境；加强网络法制教师队伍建设，改进创新网络法制教学方法等保障措施。

However, some students enjoy the network brings much convenience, but also an abuse of this right, into the restricted area of the law and regulations. With the in-depth development of network information, the students' network of legal norms of behavior presents many problems, especially since the development of the mobile phone network technology, the networking activities of university students have become more frequent, more widespread anomie of its network unlawful act, assault and murder of the chance of a substantial increase, causing a serious social problem, extremely detrimental to the establishment of the network construction and network of social order of civilized rules, healthy growth and smooth-taught college students. This became the background of the network, ideological and political education facing the most difficult, but problems to be solved. Party and government heart healthy growth of youngsters and smooth-taught, their network behavior to give a high degree of concern and policy guidance: Comrade Hu Jintao stressed that “in the Communist Youth League Fourth Plenary Session of the 14th speech while avoiding disadvantages, and actively to prevent the Internet for young people to the negative impact” ,opinions of the CPC Central Committee and State Council on Further Strengthening and Improving Ideological and Political Education with special emphasis onto make use of technical, “administrative and legal means to strengthen the management of the network, to prevent variety of harmful information in the spread of the Internet, firmly grasp the initiative of the ideological and political education”, scholars Youth Network unlawful act anomie, but also gave many valuable suggestions and comments. Therefore, the author under the guidance of the national network policy, learn from relevant scholars research on the basis of a questionnaire, to explore the legal norms the status of the students' network behavior, their rational thinking and in-depth inquiry. In this paper, through literature, sampling survey method, empirical method to analyze the study. the survey shows that current college students network behavior laws and regulations the following outstanding issues: (1) network of legal norms consciousness; (2) lack of knowledge network of laws and regulations; (3) the network of laws and regulations applicable to the poor; (4) of the network behavior widespread illegal. Through research and analysis found that the above problems for two main reasons: the negative impact of the network environment and the legal environment; colleges and universities is not enough emphasis on the education of the students 'network of laws and regulations; Students' Network of moral self-discipline lax; specific psychological motivations driven. Above theoretical analysis and practical research, learn from relevant scholars research on the basis of the education measures of the legal norms of the students 'network behavior: (1) improve the network of laws and regulations and social education, to strengthen the students' network of legal norms Awareness ; (2) colleges and universities should pay attention to legal education, to strengthen the students' network of legal knowledge; (3) adhere to the network code of ethics education, training students network self-discipline; (4) Students should strengthen self-education and management, to improve their own network of legal literacy. The same time, safeguard measures can effectively smooth implementation of the above-mentioned educational countermeasures, and asked the relevant departments should strengthen the supervision of the network, to purify the Internet environment; to strengthen the network and the legal system of teachers, improvement and innovation network legal teaching methods.
