自党的十八大以来，以习近平同志为核心的新一届中央领导集体提出全面建成小康社会、全面深化改革、全面依法治国、全面从严治党的战略思想，彰显了我们党提高执政能力和执政水平的决心和气魄。十八届四中全会的召开，并通过《关于全面推进依法治国若干重大问题的决定》，不仅创造性地把马克思、列宁主义关于国家和法的理论同中国国情和现代化建设实际相结合，而且为实现中华民族伟大复兴的中国梦从理论和实践上奠定了治国理政优良方式的坚实基础。因此，将习近平法治思想的渊源作为研究主题具有重要的理论意义和现实意义：理论意义在于丰富和发展了马克思主义法学、马克思主义中国化的理论、中国法治建设理论；现实意义在于既保证公民权利的实施和社会公平正义的实现，又有利于促进、实现、保障社会和谐，为全面深化改革等政策保驾护航，为国家治理能力的现代化提供了科学的方向。 本论文从以下思路展开论述：首先在梳理法治思想相关概念及理论基础上，具体阐述了法治与法制的含义、联系与区别，并简要论述了马克思主义的历史观和法哲学观。其次，从习近平法治思想入手，重点论述了习近平法治思想的主要内容、特征、意义、形成脉络，同时还论述了习近平依法治国思想的内容、特点。再次，以论述习近平法治思想的基本渊源为切入点，具体阐述了马克思、恩格斯、列宁、毛泽东及中国特色社会主义法治思想。最后，从对国家治理、和谐社会建设和个人人权保障三方面论述了习近平法治思想的当代贡献。

The new leading collective of central commitee of the Communist Party of China which is led by Xi Jinping since the 18th National Congress of Chinese Communist Party has proposed the strategis thoughts about building a better-off society, deepening reforms, ruling country by law and running the party strictly in a comprehensive way. And this shows us the determination and courage our Chinese Communist has in enhancing the governing capacity and its ruling level. The Convening of the Fourth Plenary Session of the 18th CPC Central Committee passed the desisions about ruling country by law on several major issues in a comprehensive way and combined the theories proposed by Marxism and leninism together with China’s national conditions and modernization constration.It has a significance both in theory and reality to take the origin of the rule of law which is proposed by Xi Jinping as the theme. The significance in theory is that it has enriched and developed Marxism in China and chinese law construction .The theory in reality is that it guarantees not only the practice of civil rights and social fairness and justice,but also the promotion of social harmony .And it shows us the way to the modernization of the capacity of national governance and ensures the practice of the policy in deepening reform . The disscussion mainly focus on these aspects:Firstly,it discusses the meaning ,the relevance and the difference both of the rule of law and the legal system which based on the related conception and theory .And it also discusses the hostorical views and law philophy of Marism.:Secondly it starts from the rule of law proposed by Xi and discusses the main content ,the feature and the significance .The content ,the feature of Xi's rule of law .Thirdly it takes the origin of Xi's rule of law as the pointcut and discusses the rule of law proposed by Marx, Engels ,Lenin and Mao Zedong :Finally it discusses the contribution of Xi's rule of law of the time in the aspects in national governance ,construction of harmonious society and the protection for individual human rights.
