伴随着计算机、数据库以及网络技术的发展,全国土地数据的管理实现了信息化,避免了原本纸质管理的不足。随着各农村集体土地确权登记发证工作的推进,各地纷纷建立了“三库”,即:农村集体土地所有权数据库、农村集体建设用地使用权数据库、农村集体土地承包经营权数据库来管理集体土地,然而随着农村集体土地内的各类土地的不断流动,造成土地权属界线不清晰,进而导致农村矛盾加剧,因此迫切需要对农村内部的各类土地进行统一管理来明确土地的界限,保护土地权利人的合法权益。本文尝试对农村集体土地“三库”进行集成。
在农村集体土地“三库”集成方法的研究过程中,本文首先对农村集体土地所有权、使用权以及对应的数据库进行了研究和分析,奠定了“三库”集成的理论基础;其次对“三库”中空间数据的含义、组织与管理、属性数据、权利主体信息等进行了具体的探讨与设计;最后结合具体的数据完成了“三库”的集成,实现了图形与属性的查询,并对“三库”的实际应用进行了分析研究。本文主要做了以下工作:
(1)以农村集体土地权利为基础,对相应的“三库”:农村集体土地所有权数据库、农村集体建设用地使用权数据库、农村集体土地承包经营权数据库从目的、数学基础、数据库内容以及权属调查等方面进行分析。
(2)将土地权属与土地用途相结合,对农村集体土地的地类图斑划分为:建设用地使用权宗地、农业用地使用权宗地、地类图斑地块,并解释了各部分的含义,为“三库”的空间数据组织奠定了理论基础。
(3)以现有农村集体土地数据库为基础,具体设计了“三库”的空间数据的组织与管理方式,并设计每个图层的属性结构,使得“三库”集图形与属性于一体;同时为实现土地确权的目的,对土地确权过程中的权利主体进行总结并设计了其信息表,将土地与权利主体联系起来,这也是“三库”的现实需要。
(4)运用ArcGIS软件的个人数据库功能,结合榆林市榆阳区项目数据,对数据库的空间数据进行了集成实现,并实现图形属性信息的查询,做到图属一致。
(5)分析了“三库”在不动产统一登记工作、土地确权登记发证工作、基本农田划定工作、土地勘测定界工作这四方面的应用。
“三库”的实现,可以对农村集体内的各类土地以及房屋进行统一组织与管理,避免土地在流转过程中出现的权属界线不清而导致的农村矛盾加剧的现象,有力保护各农民集体以及农民的土地财产权不受侵犯,同时为农村不动产登记工作提供数据支持。

With the development of computer, database and network technology, the management of the national land data has realized the informatization, which is avoiding the shortage of original paper management. The work of rural collective land confirmation, registration and certification is pushing on. All parts of our country have established the “three database”, namely rural collective land ownership database, rural collective constructive land use right database, rural collective land contract and management right database in order to manage the collective land. But with the constant flow of various land of rural collective land results in the land ownership boundaries unclarity, which leads to the conflicts in rural areas aggravating. There is an urgent need for unified management of various types of rural land to clarify the boundaries, which protect the legitimate rights and interests of land obligee. Therefore, this paper attempts to integrate the “three database”of rural collective land.
During the study of method for the “three database” of rural collective land, this paper firstly studied and analyzed on rural collective land ownership, use rights and the corresponding database, which laid the foundation of integration theory of the “three database”. Secondly, this paper discussed and designed the meaning, organization and management, property data and the subject of right information of spatial data in the “three database”. Finally, combining with specific data the integration of the “three database” was accomplished, which achieved a query of graph and properties. At the same time, this paper also analyzed practical application of the “three database”. In this paper, the main works are as follows:
(1) Based on the rural collective land right,this paper analyzed the purpose, mathematical foundation, database content and land ownership Investigation of the “three database”: rural collective land ownership database, rural collective constructive land use right database, rural collective land contract and management right database.
(2) Combining land ownership and land use,this paper divided land type patches of rural collective land into: a parcel of constructive land use right, a parcel of agricultural land use right, a parcel of land type patches and explained the meaning of every part, which laid the theoretical foundation of spatial data organization of the “three database”.
(3) Based on the existing database of rural collective land, this paper designed of the organization and management way of spatial data of the “three database” and attribute structure of each layer, which made the “three database” combine graphics and attributes. At the same time, in order to achieve the purpose of land ownership, this paper summarized the subject of right in the process of land ownership and designed their information table, which linked land to the subject of right. All above are the “three database” practical needs.
(4) With the use of personal database of the ArcGIS software, combining the project data of Yuyang district in Yulin, this paper integrated spatial data of the database and achieved a query of attribute information of, so that the graph and attribute case was accordant.
(5) This paper analyzed the application of the “three database” from the registration of immovable property, the confirmation, registration and certification of land, the delimitation of basic farmland, the survey and demarcation of land this four aspects.
The achievement of the “three database” realized the unified organization and management of the various types of rural collective land and houses, avoided the aggravating conflicts caused by the phenomenon of unclear boundaries during the rural land transfer process, protected all the collective farmers as well as farmers' land property rights from violating and provided data support for the registration of immovable property.
